Legal Question in Family Law in New York

Child born out of wedlock

My daughter is not my ex-husband's child. However, his name is on my daughter birth certificate because were separated not divorced. How can I now remove his name from her birth certificate and give her my last name only since now she carries both of our last name(hyphenated).

She is turning 10 this summer.
