child name change

My child was never legally adopted by her step-father, howver we are interested in changing her name to that of her step-father as this is the only father she has ever known. Do I need approval of her birth father for this?

What is the process for this?

it usually is required for the birth father to consent especially if his name is on the birth certificate otherwise a court proceeding is necessary

Changing a child's name is a simple procedure. It is made on petition to the supreme court of ny. If the father's residence is known, then it must be made on notice.

The approval of the father is not necessary. However, if the father has exercised his right to visitation and/or paid consistant child support, he will have an opportunity to block the change.
