Child custody
Hi. Thank you in advance for your
answer. My girlfriend left NYS with
my one year old daughter to Texas.
She filed for custody in Texas,
however, the judge denied it on my
motion of non-jurisdiction because
she just left four months ago. I
have filed a petition for custody in
NYS, but my girlfriend is avoiding
being served by having her sister
say she does not live there.
Because it's a V case, she has to
be served personally. My court
date in NYS is Jan. 8th. What do
you suggest I do?

If you do not have legal representation, you should consult with an attorney as soon as possible. On the return date, you can explain the difficulty to the Court and ask for leave to serve by alternate means.

Get a better process server or try to have her served by the sherrif of the county where she lives. Go to the Court and ask them for help as well. Unless you decide to retain a lawyer.
In custody cases, it is important to have good representation. A lawyer will find a detective who will get this served for you. It is an expense well worth it if you want to see your child.
