Legal Question in Family Law in New York
The child custody agreement that has been formulated and isgned says that there will be no exchange of child support.
But will salary and bonus be considered in financial settlement?
1 Answer from Attorneys
First of all, child support cannot be waived by the parties. The court needs to see the proper amount of child support in the divorce papers. Whether or not you decide to collect the support from your spouse is up to you, but the papers must provide for support.
As far as the overall financial settlement, things like salary, bonus, retirement funds (pension, 401K etc.), professional licenses, spousal maintenance, real and personal property, and more should all be addressed as part of the settlement. I strongly suggest you consult an attorney to discuss these things. There are many factors to consider and you need to protect your rights, many of which you may not be aware of.
