Legal Question in Family Law in New York

child custody

my daughter and I live together. She took off for1 week and left her 2 kids with me. Her ex took them for visitation and will not return them. He's claiming she abanded them. He currently has supervised visitation. He has petitioned the court but my daughter can't find anything out when she calls. He lives 300 miles away and it is through that county court. What should she do?

Re: child custody

She must file a writ for habeas corpus for the childrn to be produced before the Court. She would then take the children home under the prior custody order. This should be done immediately.

Mike.
