Legal Question in Family Law in New York

Child Custody

My ex-boyfriend and I have joint custody of our 6 year old daughter. Custody was awarded in NM and the court gave my ex permission to move to NY with our daughter so he could continue to live with his mother. I live in AZ where I always have, our daughter now lives in NY with his mother against my wishes and he has moved back to NM to live. He tried to keep the fact that he moved back to NM away from me. What can I do to get physical custody back?

Re: Child Custody

Suggest you file a modification of custody petition in the Family Court of the County and State where your daughter now resides, i.e., with her grandmother in NY.

It appears that your ex-BF does not wish to have custody.

If you wish to discuss this with me privately, please call to schedule a confidential telephone consultation.

I practice in NYC and Long Island.
