Legal Question in Family Law in New York

Child Custody

My ex-boyfriend and I had a child in 2004. We are no longer together and i have not had contact with him since I left. He signed paternity papers and my child has his last name. I am currently living with my present fiancee and we also had a child together, he wants to adopt my 1st child as his. He provides 100% for him and the child calls him daddy and he's the only one he's known as such. I don't know where his biological father is but I want to know what I need to do in order to get my fiancee to adopt our child??? Please help me.

Re: Child Custody

New York statues provide for courts to terminate parental rights of a parent who has not supported or shone any interest in their biological child for a sufficient period of time. If you don't know where the absent parent is, a court may, under specific circumstances, proceed without the parent present. There is also law that governs the adoption process. I recommend that you have legal representation before you undertake to do either termination or adoption.
