Legal Question in Family Law in New York

Child Custody

I am a father of an adopted child. I am legally seperated and pay child support biweekly which is taken automatically from my paycheck. My wife has not allowed me to see my daughter for one year. Please tell me what forms i need to file, where to find the forms and how to process them.

Child support and visitation are independent obligations. So just because you make child support payment does not give you the right to see your child. The opposite is also true, failure to make payment does not stop your right to see the child.

The Court determines visitation by reviewing what is in the best interest of the child. There is a presumption in the law that a child needs the support and love of both parents. Therefore, visitation is encouraged.

I strongly suggest that you go to Family Court in the jurisdiction where the child is located. Most, if not all, Family Courts have an intake room. Family Court staff will prepare and deliver the necessary documentation to the Mother so that you may appear before a Judge to work out a visitation schedule.
