Child Custody

I have joint custody with my ex-husband of our son. Recently my ex has been beat up for owing money for drugs, has had two vehicles taken from him because of this. He is on drugs. I have concerns of my sons safety and my safety. Should I file a modification to go for full custody, if so how should I word it.

Can this be done before his next visit the weekend of October 2th 2008?

Yes, you can go to family court to get sole custody of your son. Based upon the information in your posting, you should be able to get the court to order a modification of your ex-husbands visitation.

As for how you should word a petition, you should get an attorney as soon as possible since this is a very touchy situation and you want to word the petition carefully. You can also go to the family court and have the intake clerk at the probation department help you with the petition. They write these everyday.
