Legal Question in Family Law in New York

Child Custody when the other parent is an alcoholic

I was divorced in 1991. The main reason was that she had drank liquor excessively and became unreasonable and verbally abusive. We have a child and have joint custody. He lives with her. For the past four years she has been sober, but lately I've noticed that she has begun drinking (I've smelt it on her breath and she slurs her speech.) I want to know how I can go about getting full custody of my son. He is currently 12 years old. I can provide for him in a loving caring household. Please respond ASAP. I am very concerned about my son as he has told me several times that he would like to live with me. He calls me at home at least twice a day and sounds depressed. I have him with me every other weekend and he has expressed to me that he doesn't like going to his mom's house. I also take him to dinner once a week and he enjoys our time together. He is an excellent student and a well rounded boy however. I must admit that she has done a good job with him since she stopped drinking several years ago. I fear however, that she has begun to drink again and that worries me. All the good that she has done for him can be quickly erased with a few psychotic alcoholic episodes.
