Child custody

I am researching a book I am writing. I need to know if both biological parents are deceaced, can the father who is named on the birth certificate retain custody of the child born during the marriage. Even if he is not the biological father?

It's not clear what you mean by "named on the birth certificate" - if the child is born during the marriage and a father is listed on the child's birth certificate as the father of a child, that person presumptively is the child's father.
