Legal Question in Family Law in New York

child custody

When my son recently went to pick up his son for his visitation. His ex

girlfriend came over to the car and hit and punched his present girlfriend and

him in front of their 8 year old son. She also kicked and hit their car. Is their

something he can do to protect his son from this happening again? This is

the second time this has happened in front of their son. He did report both

incidences with the NY State police and pressed charges both times. Can he

possibly get custody of his son??

Many factors, including a parent's temperament, criminal record and history of violent behavior, are considered in determining a child's best interests, which is the standard applied in custody proceedings. Your son should consult with an experienced attorney as soon as possible.
