Legal Question in Family Law in New York

Child custody

Sounds like it is in my best interests to file for joint custody so we make the decisions for the child And if we file for joint custody is it an automatic she will get physical custody?? How is that determined? She does not work and has 2 children that she recieves child support for from a previous marriage. Also how will this effect my visitation if she gets physical custody?

Custody is not automatic.

The best interest of the child is the determining factor.

Are you interested in obtaining physical custody?

If you are then you should make this known when you apply for custody.

Are you able to care for the child if the child lives with you?
