Legal Question in Family Law in New York

Child Custody

My stepsons father keeps going in and out of jail and each time he gets out he makes false promises and we (my wife and I) are stuck watching his disappointment. He never stays out of jail for longer than a few mos. And everytime he gets out we have to go to court so he can try and get visitation/custody. Is there any possibility we might be able to implement a stipulation with our agreement to supervised custody that would make him relinquish all and any rights if he returns to prison again? It has been very costly and there is no price you can put on the amount of hurt my son is feeling. Please Help.

You need to document the effect this is having on your child. If you are hauled back to court, you should seek to have forensics done on the boy. Get legal counsel. If you have had counsel, then get one that is more aggressive. This playing with the kids emotions is most unfair.
