Legal Question in Family Law in New York
child custody transportation
my husband has always lived within 10 minutes of his ex-wife and child. His child is 11 years old. He recently has moved, and notified his ex-wife of the move beforehand, and now lives 30 minutes away from his child. They have joint legal custody of the child and are ordered 50/50 transportation--his ex-wife is taking him to court for moving 30 minutes away because she does not want to do the driving....does she have a case?

Re: child custody transportation
She may - what exactly does the custody order or agreement say? How many miles was the move? Was it within the same county/city/state? Please call me at 212-367-9167 to discuss this in further detail.
Re: child custody transportation
For what? For changing the terms of driving? For affecting visitation? For increased compensation for gas and wear and tear costs to the car?
Your husband is not going to lose his visitation rights for this kind of move, but the parameters of the agreement have been altered by him and accordingly some modifications to the agreement may occur.
