how do I get custody of my child, she is in a very unstable, unsafe home, with her mother

Assuming that you are not talking about a divorce, and that NY has jurisdiction, you can file a petition in Family Court. The law states that custody is to be determined in the best interests of the child, but you should consult an attorney to see how the standard applies to your particular situation.
