Legal Question in Family Law in New York

Hi, I have one child and I'm married to non biological father of my child. my husband want to adopt my daughter. my daughter was born here in New York and the father is outside/residing the country, we don't know where to find him. now me and my daughter lives in NY but this coming November we're going to move in California where my husband is based. my question is, can my husband apply the adoption in California even my daughter was born in NY? thank you

As a New York attorney I cannot speak to the laws of California.

However, in New York you need the biological fathers consent to allow the adoption. I would check with a California attorney to see if the same requirement exist in that state. I would be surprised if it is not.
