Legal Question in Family Law in New York

child in another state

Moved to new york. lived here for ~1 year with girlfriend and daughter(2 yr old). This is where my job is. Went on vacation to maine, girlfriend said she was staying with her family and keeping our daughter. Her legal residence is new york as is mine. Can I legally force her to bring our daughter back to new york? They have only been in maine for ~2 weeks.

Since child lived in NY for over 6 months, legal residence is in NY. You would have to file a custody proceeding in NY Family Court, and serve the mother in Maine.
