Legal Question in Family Law in New York

Child support adjustment

I've been divorced about eight years and have full custody of my two boys from that marriage. In NY, where we lived at the time, there was a set amount based on a percentage of my husband's salary that was to be paid as support. Since then, his salary has tripled and my payment for the boys remains the same. What steps can I take to have the amount adjusted. He lives in NY and I'm in CT. Will this be an expensive venture and will I need an attorney or is it a matter of filing forms?

Re: Child support adjustment

This is more than a simple filing of forms. You would have to petition the court for an adjustment. If you need help, you can email me at [email protected].

Re: Child support adjustment

You need a modification of the initial order and a motion needs to be filed to accomplish this. Although this may be doable on your own, you will better protect and assert your interests by having the assistance of an attorney.

Re: Child support adjustment

I'm not familiar with the child support rules in NY, but if NY has a state child support enforcement bureau like CT, you can ask them to assist you and they will prepare and file the necessary forms in the original divorce action. This assumes the procedure is similar to CT. Otherwise, you can have the NY divorce decree registered in CT and enforced/modified like it was a CT decree in a CT court.
