Re: Child support

IN NY THE AGE OF MAJORITY IS 21, IN MOST OTHER STATES THE AGE OF MAJORITY IS 18.

A COURT CANNOT ORDER CHILD SUPPORT BEYOND THE STATE'S "AGE OF MAJORITY." HOWEVER, IF NY IS THE "ORIGIN" STATE OF THE CHILD SUPPORT ORDER,

AND THE CHILD LIVES IN A "18 YEAR OLD" STATE, NY

LAW WOULD CONTROL AND THE COURT CAN ORDER SUPPORT TO 21. IF THE PARTIES CONSENT SUPPORT CAN CONTINUE TO COMPLETION OF COLLEGE, ETC.,

YOU SHOULD ALSO NOTE, THAT A NON CUSTODIAL PARENT DOES NOT HAVE STANDING TO PETITION THE COURT TO EMANCIPATE A "CHILD, ENDING THE CHILD SUPPORT OBLIGATION, EVEN IF THAT CHILD HAS A CHILD, IS A DELIQUENT, AND IS GENERALLY OUT OF CONTROL.

THE COURTS ARE NOT "EMANICIPATING" AS THEY DID IN THE PAST, IF THE CHILD IS LIKELY TO REQUIRE PUBLIC ASSISTANCE.

SO... THEY TEND TO ENTERTAIN A PINS PETITION, THAT REQUIRES ONGOING SUPPORT WHILE "THEY" "CONTROL"

GOOD LUCK.

Re: Child support

In new york child support ends at age 21.But this is not absolute .It could end if child is married or has a full time job and becomes independent. For example a 19 year old who joins the US army or NY police as a full time officer does not need support.Support may continue until graduation from College if the parents have the ability to support the child thru college.

Health insurance and other forms of benefit will be provided until age 23 if child is in college or learning a trade

Re: Child support

Child support ends when a child is deemed to be emancipated. Being emancipated is determined by the consideration of the following factors: the child's marriage; reaching the age of 18; graduating from high school and not pursuing higher education full time; working full time; completing four years of college or reaching the age of 23.
