Legal Question in Family Law in New York

Child Support after age 21

My child has just turned 21 years of age, is a full time student who lives away from home. I want to send her child support directly to her while she is in School. Right now my ex wife gets the money and does not give her any of it. What is the law on this?

Re: Child Support after age 21

If there is an existing child support court order and the support payments were not automatically terminated; or otherwise continued per a divorce stipulation or court order, as of your child's 21st birthday,.... you should file a Family Court petition for termination of child support, effective (nunc pro tunc) the date your child turned 21.

You may then provide your child directly the "child support" or any additional monies you and your child deem necessary.

GOOD LUCK,
