Legal Question in Family Law in New York

child support and bankrupcy

Help. I woke up today and realized that I have been charging my child support for the last three years. I have remarried and have two step children as well as a two year old. I have two children that have left Texas with their mom and I never see them except in the summer time.

I rarely speak with them on the phone and never get any updates on their school progress or my ten year old's medical condition (she is on Ritalin; although when I had her tested in Texas, her home state, the professionals said she did not have ADD or ADHD. Mom decided that she ran around the house after school too much).

My question basically is there anything that I can do to get the child support reduced so that my new family will not have to go bankrupt. We are not extravagent in our living expenses but we need the extra $600 a month just to get by. We drive a 1984 and a 1985 vehicle with over 100k miles on each. We are also only spending about $100 per week on groceries. Everything that breaks, cars home heating, etc. MUST be put on credit as well as clothing, shoes or any entertainment.

Modification of child support order

Child support orders such as the one you are aparently subject to may be modified. You are entitled to file a suit for modification, seeking to reduce the amount of child support. Without knowing exactly what your net resources are, and what other considerations there are, I can't accurately predict what your chances are of reducing the child support payments.
