Legal Question in Family Law in New York

child support

My ex boyfriend and I have one each of our kids. He gets SSI for himself and SSI for our son that lives with him. Our Monroe County Child Support Enforcement Unit says they cannot take child support from these sources of income. Is this true? He has a standing order that he has not paid on in years. Our son has been with him only for 2 years. Now he is taking me to court for support. Can I counter sue based on the fact that he owes me more than I might owe him?

You have a right to the support you are owed. You can countersue your recovery will be reduced by the amount you know owe your ex. You should see an attorney to be sure that you're issues are correctly addressed.
