Legal Question in Family Law in New York

child support

my boyfriend and i are seperating, he is the father of my child. he makes about 700.00 a week, half on the books, half off. how do i go about getting a percentage from his whole paycheck if its all not on the books..

Re: child support

You can bring a petition for child support in Family Court. The Family Court deals with these kind of cases everyday, and are well aware that often people make money off the books. You need to advise the court that he makes a substantial amount of money off the books. There is no reason why they would not award you child support based on his real salary.

I agree with Attorney Finch and would only add that which is probably obvious:

You can file that petition with the Family Court by going there, yourself, early some regular business morning, preferably with the child's birth certificate and any acknowledgment of paternity signed by the father "in hand". Staff at the Family Court will help you with the paperwork. Plan on spending, at most, a couple hours there.
