Legal Question in Family Law in New York

Child Support

The company I work for sometimes grants monthly bonuses based on the performance of the company as a whole. The bonuses are not guaranteed and vary in amounts depending on percentage of goals reached. Sometimes, I may not see a bonus for 6 months or all year. Sometimes my bonus could be $1200 or $200. Will the judge use my non guaranteed, non predictable bonuses in calculating my child support obligation. If the court does, this could cause a hardship to me as I may not see a bonus for a long time.

Re: Child Support

I think you ought to offer to the court that you will allow the boss to notify the court when a bonus is paid, and you will voluntarily pay your increased child support obligation, but that the guaranteed amount should only be based upon your base salary.

Good luck.
