Child Support

There is a court order for my son to receive child support until he turns 21 because he has a disability. His father(lives in New York) stopped paying because he knows he stop for one year one other time and he was never arrested. If my ex ever retires or draws social security can child support be taken from that income

If your child's father defaulted in paying child support, for any time, YOU may file a Family Court Petition to hold the father in Contempt of the Court Support Order.

You should not wait. But, seek immediate relief, each and every time the default continues for more than 3 months.
