Legal Question in Family Law in New York
Does child support = custodial status? If a mother relinquish or agrees to have child support stopped, does she have to give up custodial parenting status?
1 Answer from Attorneys
Child support is the financial support by a non-custodial parent of the child. It is the right of the CHILD to receive child support.
Custodial status is the legal determination of who has physical and/or legal custody of the child.
While the two interrelate to some extent, they are NOT the same, and child support does not determine custodial status.
