Legal Question in Family Law in New York

child support deducted but not forwarded from employer

what can you do if the court ordered child support is being taken out of your check because your paystub proves that, but obviously the employer is not forwarding it to the child support collection agency because now you have received notice that you are over $1000.00 behind on payments and you are to turn in your plates, license, etc. ? Can you fax copies of your paystubs to the agency as proof, and they can go after your employer?

The first thing you should do is ask the collection agency for an accounting. If there is a conflict between your calculations and theirs, you'll need to provide them with proof that the money has been taken out of your paycheck.
