child support ''fairness''

albany cty. i am sole provider for 3 children with my wife. one of children is handicapped. i have a previous relationship which yielded 2 children. why does the court totally disregard the children ''after'' the ones in court. because of arrears and constant battles with a very vengeful ex, i face 6 months in jail leaving a family of four, inc 3 kids( one of which handicapped) vurtually homeless. can a judge actually show a deprivation to a current suituation. it is obviously more detailed but that is basically it. an ex who lives a semi-extragant lifestyle...including 2 dwi's in the last 3 years controlling the situation and refusing an offered payment schedule to make up arrears to basically bust my #@#%. and i barely struggle to meet her high demands of a support order and can barely put a roof over my family now. is it true that the rich get richer and the poor die trying???

The law does provide for such circumstances to be considered in hearing petitions for both modification and/or enforcement of child support orders. As you are aware, there are very serious consequences for violating an order of support; you should conult with counsel immediately and be prepared to hire an attorney to represent you any legal proceeding.
