Legal Question in Family Law in New York

child support & guidelines

If my original ny child support agreement did not follow the guidelines can interest be charged in the case of arrearage? Interest is not stated in the agreement. If interest does apply does it start to accrue from the date of money judgement or retro to the original agreement signing date?

Re: child support & guidelines

My question is why didn't it follow the guidlines? Did you have an attorney then and was it court ordered or did you both consent on your own? If it was court ordered, then you should have objected soon after the order was issued. If you both agreed to the amount - before a magistrate would sign off on the agreement, the magistrate usually double-checks that the amount complies with the guidlines. Basically, I would need more informatin before being able to properly answer this question.
