Legal Question in Family Law in New York

child support

My husband is being put through the cleaners. His ex-wife went on welfare in 1998 and the welfare system took him to court for support. He has custody of them although they chose to live with her. In 1998 one was 18 years old and working and the other was 15 years old and quit school. They boys are now 20 and 17 and neither of them live with her but they are garishing his wages. We can not afford to pay the welfare department $500 a month. What can we do. We can not even afford the lawyer to fight the order of payment please help me. Any suggestion is better than what I have been coming up with. thank you

Re: child support

If the children are living with the mother, she recieves child support. If your husband did not pay child support for several years, the arrearage can pile up pretty fast. A judgment for arrears may have resulted in the current payment amount because $500/mo. child support indicates an income of about $25K/yr. I don't know what your order reads, but it may provide for payment of the $500/mo. as child support and to be applied to the arrears until that is paid. There is no way to avoid paying child support other than disability.
