Legal Question in Family Law in New York

child support

My husband and I are separated. He gives me 125/week. He threatens me if I go to court for more child support that he will go out on permanent disability and I will get nothing. He earns around 80,000. What will I get if he goes on permanent disability.

Re: child support

If the Court finds that he voluntarily reduced his income to evade child support obligations, they can impute income and/or base an order on what they deem his true earning capacity. The amount of the order will depend on the Court's determination of his income, the number of children and other factors. You should be gathering evidence to make your case if necessary.
