Child Support
My husband has been voluntarily paying child support for his daughter from a previous relationship since she was born. His daughter recently turned 18 years old and has decided to wait to start college until January. She is working full-time at Wal-Mart. Her mother still wants us to pay the full amount of child support. My husband verbally agreed to pay for his daughter's car insurance ($130 per month) and to again resume child support payments in January when she attends college as long as she is going. Her mother has now threatened us to go to court to get the money. There has never been a child support order issued and they were never married. Until now, things have been amicable. We give her $350 per month, plus we pay 1/2 of things she may need for school. We live in Fulton County New York. My husband and I have 2 other children ages 4 and 11. Things have been increasingly tight financially this past year and we are trying to do the right thing, but information on internet is confusing. Some places say you have to pay child support until the child is 21, but in others it states that child support needed to be applied for before the child reached age 18.

In NY child support is paid until the age of 21, or until emancipation, whichever is sooner.
