Legal Question in Family Law in New York

Child Support Increase

Would like to know if it's worth my while to ask for increase in child support and for help from the ex for college for the children. By agreement of early 90's, between my ex and myself, he currently pays $1,000/mo. for two our two children, ages 15 and 18, ($100 of that is alimony). His current yearly salary is approximately $80,000+; Mine is $38,000. I have not remarried; he has. Neither of us have children from other marriages. His new wife of 3 yrs. has two children of her own, one emancipated, one under age who lives with them. His new wife is a teacher's assistant and makes approximately $15,000/yr. In addition to needing an increase in monthly support, can I seek his help for college fees for the children. There is no provision in the current agreement for college.

Re: Child Support Increase

Based upon the children's increased needs you can seek a modification in support and you should expect be awarded approx. 25% of your ex's pretax income. He made be ordered to pay additional funds for the children's college expenses.

I suggest you consult with an attorney.
