Re: CHild Support For Four kids
In NY, when parents divorce/separate, the parent with whom the children reside can obtain an order of support in accordance with the "CSSA" (statutory) guidelines; for four children, that would be 31% of the non-custodial parent's income, plus a share of some additional expenses and subject to discretionary adjustment for a variety of factors. In cases like yours where income may be difficult to ascertain, the Court has the power to impute income and/or order support based upon earning capacity. The obligation to support one's children continues even if the person leaves the country, although enforcement and collection may be more difficult and may depend on the laws of the foreign jurisdiction. Consult an attorney for advice relating to your particular situation.
