Legal Question in Family Law in New York

Child Support Laws

My daughter lives with me and I fully support her. I claim her on my taxes, when I go to court for a child support order will her father be able to claim her on his taxes and not me? Will I have to pay for the paternity test if he wants one and doesn't have the money?

Re: Child Support Laws

You should be able to keep the tax deduction for your daughter. This often is a point which is negotiated in a child support matter, and the parties can choose to alternate the tax deduction.
