Legal Question in Family Law in New York

child support

I live in NYC and am currently being

told that the laws regarding child

support are that the courts impute

child support based on the last taxes

filed. My ex has decreased his income

by half 2006 and I am being held

responsible for 40% of the costs of

our children. In the 3years before,

he made 3x that amount. Also

would a judge force me to sign

divorce papers in two days? I just

received the first settlement

agreement on Friday, read it over

the weekend, and am being told that

despite my questions, i must sign it

by tomorrow afternoon or else, we

risk going to trial.

If you have an attorney, then he/she should have brought the prior earnings to the Court's attention. If you have an attorney for the divorce, then he should advise you as to whether there is really a trial date pending. The court may want to set a trial date, but you should ask the attorney.
