Child Support Mod

My fiance has 2 kids. In NY, can his ex-wife ask for more child support for any reason or do there have to be certain circumstances? He's afraid that if he takes her to court to try to change visitation (she moved out of town and visitation as in Court Order is impossible), that she will ask for more support. His papers currently say he is to pay $150/week and that CSSA was waived.

She will no be able to make a successful claim to greater support absent a showing that the child's needs have changed considerably.

Regarding her moving away, was this done with yours or the court's permission? If not, she may be required to take the child to you for visitation at her own expense.
