Child Support

Myspouse pays child support, can it be based on my income? Does the CSEA need my income for any reasons?

Technically you both are responsible for a pro-rated share of child support. The CSSA figures child support by using both parents income, multiplying it by the applicable percentage (17% for one, 25% for 2, etc) and then pro-rating the non-custodial parents share.

If the child is in NY, the CSSA provides for the child support to be calculated on the sum of both parents income, and then apportioned according to each parents income.

Under certain circumstances, your income can be imputed to your husband, for purposes of his child support payments to his former wife.
