Legal Question in Family Law in New York

Child Support Order against me

Recently I received a letter in the mail that asked me to appear in family court regarding my ex girlfriends almost 2 y/o child. When she became pregnant, I offered to pay for an abortion which she had agreed to, she than fled NY and moved to FL. and had the baby without my knowing. Now she is reuqesting child support, retro support and medical. On her documents she acknowledges that I offered an abortion, and she admits she slept with other people during the time. Am I obligated to take a paternity test. I want nothing to do with the child, I was made to believe that she had aborted the pregnancy. Do I have any rights since she left the state and admits that I was going to pay for this service. Also, Im moving to virginia in January and she requested NY's maximum child support, if I am required to pay, can the judge order it based on Virginia pay. I know I should hire an attorney, but everyone I have called wants $1800+ and I can't afford that

Unfortunately, you will be obligated to pay and/or request a paternity test. What she did or did not do is of no consequence. If the child is yours, you should do a DNA then you must pay based on NY law since that is where the child lives. If not then you don't have to worry about paying but you can't ignore or avoid the issue.

Find a way to pay it or be ready to pay a lot MORE. Yes she has every right to all the things she is requesting and all you have is the right to a paternity test. If you want the payments to be based on Virgina payouts, I strongly urge you to give up lunches and maybe a few dinners and gete thee to an attorney.

Good Luck.
