Legal Question in Family Law in New York

Child Support

I currently pay support for my three children who have resided with their mother and her common-law husband for the past 3 1/2 years. Recently, my eldest child moved in with me. I am thinking of going back to court to have the support reduced. My question is: would both my ex-wife and her common-law husband's income be used to determine household income?

Re: Child Support

No. Your ex wife's common law husband has no legal obligation to support your children. His income will not be used to calculate her support obligation or to reduce yours.
