Legal Question in Family Law in New York

Child Support

I pay my child support to the State of New York. The have placed a item on my credit report claiming that I owe past due support. I brought the support enforcement people proof of payment and this item is still on my credit report. I have called several times and they will look into the problem is the answer I get. The Fair Credit Reporting Act says all information reported is true and accurate yet even with proof of payment they still report this. How do I get them to correct this information. My credit card raised the interest rate based on this information. This has gone on for over a year and need help.

Re: Child Support

There are several ways to proceed. I would be happy to meet with you and draft a letter for you for no fee. That often will clear up this type of problem.

It is best to work on the credit reporting side, but that may not solve the problem. To 'force' the enforcement people to act requires an 'Article 78' proceeding. It is not complicated, but there are a couple of levels of civil procedure on this action.

You are welcome to a consultation for no fee at my offices at 42 west 44th street, NY,NY. Please call for an appointment first (646) 591-5786.
