Legal Question in Family Law in New York

Child Support Payment due while suspended from work.

A final order has already been established, with an arrears due. Non Custodial parent want to argue in court that amount due. He feels that because he was suspended and did not received pay he then should not be responsible for payment. Is this so?

He could have asked the Court for an abatement when his job got suspended, but he still would owe the money. HE STILL WOULD MAKE UP THE PAYMENTS WHEN HE GOT BACK TO WORK. Since he didn't the arrearages stay the same.

The child still needs support and his obligation remains.
