Legal Question in Family Law in New York

Child Support Payments for Autistic Child

A recent modification request was issued by the Father to eliminate child care assistance because the child will be 13 this year. The child is autistic and will require child care for an undetermined time, depending on development and critical thinking skills. Does he have a right to take this assistance away from the child?

Re: Child Support Payments for Autistic Child

Due to special needs the court would not necessarily termimate child care just due to age. However you should be represented. You can call for a free consultation at 516 466 5297

Re: Child Support Payments for Autistic Child

If your child REQUIRES "child care" in addition to basic child support and you are able to prove your child's need, then the Court is likely to deny the father's application for termination of the child care add on.

Good luck,
