Legal Question in Family Law in New York

child support for the previous years

What grounds should I have in order to collect a child support for the years before I filled a child support petition? My court date is in 2 month and I just found out that the father of the child has been working for the past several years making 45000$ a year and had a car paying 323$ monthly. He kept telling me that he has been unemployed and it was a lie. What documents should I bring to court?I have his e-mails where he complains that he doesn't have a job and my e-mails to send me money becauase I pay 800$ monthly to a sitter. Do I have a chance?

Re: child support for the previous years

In NY in general you can be awarded support to the date of your request, i.e. to the date of your petition. However, if you had a prior order that included any provision for the payment of daycare or an increase in support or support based upon his income, you might have the right to back support. Was there a prior order? Email more information to me at [email protected].
