Legal Question in Family Law in New York

Child Support

My question is, I have an aunt who isn't married to her daughters father. They were never married and they recently started to talk about their child's financial situation, etc. The daughter is 15-years-old and is attending Catholic school. He promised my aunt that he would help out with the payments and such. It's been 2 months since they last spoke and she says he doesn't pick up the phone and is avoiding her. My question is, can she legally make him support his child after this long? Any help would be great.

Re: Child Support

Yes, your aunt should bring a petition in family court for support as soon as possible, immediately! The father has a legal responsibility to support his child and your aunt could bring the action even the day before her 21st birthday but the support order will only be retroactive to the date she files the petition so you must bring the action now.

If you or your aunt wish to discuss this matter further, you can contact my office at 516.746.4747 or [email protected]
