Legal Question in Family Law in New York
Child support question
We separated more than 14 years when my son was 5.5 years old. Never went to court. For the last 14 years, every month, I gave her $2,000.00 while I didn't have a place to live. While I borrowed money from other and make sure I have the money to support my son. As my son is 19 1/2 and working, I thought I could stop the payment, which I did on 6/15/2008. She served me the summon few week thereafter. I realized and agreed to continue support my son till he is 21. The question is...
Does the court based on my past and current income to determine the amount or the date she filed the paper and onward? I was told by a lawyer that the court didn't care what was in the past in term of how much and how difficult I have been or paid her. Court only looks forward from the date she filed. In that case, should the court calculate the amount based on my current year income or all other previous' years?

Re: Child support question
Previous advice received is correct. The court would calculate based on current year income - or income from 2007.
