Legal Question in Family Law in New York
child support
I recently obtained custody of my son, june 1st. I have been paying support to his mother. I filed (june 13th) for her to now pay support to me and stop support payments to his mother (2 petitions) but they're still taking support from me, I have a court date July 27th. Will the court continue to take support up to july? How can I stop support payments to the mother?

Re: child support
Only the court can order that support payments be terminated. Since you already have a court date you will address that then. IN the meantime, however, the Order of Support currently in place will remain in effect. If the court awards you support, you should be credited for the amount paid from the time you filed your petition.
