Legal Question in Family Law in New York
child support
I am currently recieving child support for my son. My question is, he is going to attend college his senior year of school and doing this through the high school they do not qaulify for the grants that he would be eligable for when he is out of high school. I will have to pay to send him to college which is at a discounted rate. My exhusband makes 4 times what I make and can afford to pay at least half. So my question is can I take him to court because he will not pay any of this on his own or would that be considered part of child support.
Thank You for your Help.

Re: child support
It would be better to talk to your EX or have your youngster talk to his father about his hopes, dreams and plans for school, and a career.
Then your youngster should ask for his dad's assistance, after full disclosure of the financial problems and tuition money issues, involved re the college, he wants to attend.
If the Ex agrees have him memorialize in writing, his committment to contribute to your youngsters college education. The writing can be enforced by the Court, if your Ex attempts to renege.
Keep in mind, your youngster may need to give up something, to your Ex, like time, sweat etc., if he has been estranged from dad, and is only talking to him, because he wants money.
The Court may not require payment for College. It is not child support nor a required "add on." But, the Court can and probably will increase child support, if your Ex's income has substanially increased, since the child support order was entered, or last modified.
Good luck,
