Child Support

I have remarried, will my present wifes income be considered by the Family Courts? We have been filing a joint return, should we be filing seperate returns?

Under the CSSA, the new spousal income

is not to be used in the formula

It could come into play if a "needs

analysis" is done, because it becomes

"available" to offset household expenses

But a needs analysis is done only where

there is a lack of cooperation and/or

special needs for the child

You may want an attorney to review it all

Filing separate returns in not necessary.

If your ex wife sues based on your current wife's income, retain and attorney and fight the case.
